These Terms of Service ("Terms") also govern your access to and use of AIscholar and all related services available at https://www.aischolar.com.au.

These Terms of Service ("Terms") outline the conditions for your access to, and use of, all services available on aischolar.com. Your access and use of the aischolar.com website is conditional on your acceptance of, and compliance with, these Terms. If you do not agree to these Terms, then you may not access or use any content on aischolar.com.

aischolar Pty Ltd may change, modify, add, or remove any part of these Terms; or change, modify, add to, or remove any content, or any other aspect of aischolar.com without notice or liability. Your continued use of aischolar.com constitutes acceptance of any changes to the Terms.

As users, researchers, or institutional representatives, you may be required to register to use online services on aischolar.com. You are responsible for protecting the confidentiality of your access credentials (login name and password). Please contact us at support@aischolar.com if you suspect unauthorised use of your account.

➡️ 4. Paid Services and Cancellation

Certain premium services, databases, or analytical tools on aischolar.com are only available to paid users. Paid services cannot be shared with, or transferred to, another user or institution. Services may only be purchased for the non-commercial educational or research purposes of the registered user unless otherwise authorised in writing by aischolar Pty Ltd.

Weekly Subscription Cancellation: Users on a weekly payment plan may terminate their subscription at any time. The termination or suspension of the service will take effect from the next billing cycle.

Refund Policy: Upon termination, any eligible refund will be calculated based on the number of weeks already used and the standard weekly rate. The remaining balance of the prepaid fees will be refunded to the user.

Any user who does not comply with these Terms, or who uses the website in a manner deemed to be inappropriate ("Misuse"), or who engages in unlawful behaviour, may have their access to aischolar.com terminated immediately without notice or liability.

6. Eligibility

You must be at least 18 years old to create an account. Parents or legal guardians may create and manage accounts for children under 18.

By registering an account, you confirm that:

• the information you provide is accurate;
• you have authority to act on behalf of any child using the account; and
• you will comply with these Terms and all applicable laws.

7. Educational Purpose

AIscholar provides:

• OC and Selective School practice materials;
• AI-generated learning recommendations;
• progress analytics and reporting; and
• educational support tools.

AIscholar is an independent educational platform and is not affiliated with, endorsed by, or sponsored by the NSW Department of Education.

All practice materials are intended for educational and preparatory purposes only.

8. Accounts

You are responsible for:

• maintaining the confidentiality of your password;
• all activities conducted through your account; and
• notifying us immediately of any unauthorised use.

We may suspend or terminate accounts that violate these Terms or compromise the security or integrity of the platform.

9. Subscriptions and Payments

9.1 Subscription Plans

AIscholar may offer free and paid subscription plans with different features and usage limits.

Current pricing and features are displayed on the Pricing page and may be updated from time to time.

9.2 Billing

Paid subscriptions are billed in advance on a recurring basis unless cancelled before the next billing date. Users on a weekly payment plan may terminate their subscription at any time; the termination or suspension of the service takes effect from the next billing cycle.

9.3 Refunds

Upon termination, any eligible refund is calculated based on the number of weeks already used and the standard weekly rate. The remaining balance of the prepaid fees is refunded to the user.

Unless required by Australian Consumer Law:

• subscription fees are generally non-refundable for partially used billing periods;
• accidental duplicate charges will be reviewed and corrected where appropriate; and
• refund requests may be considered at our discretion for exceptional circumstances.

10. Acceptable Use

You agree not to:

• copy, reproduce, or redistribute our question bank or learning content without permission;
• use automated tools to scrape or harvest content;
• attempt to reverse engineer the platform;
• interfere with security features or system operations;
• upload malicious code, viruses, or harmful material;
• use the service for unlawful, misleading, or fraudulent purposes; or
• share paid account access with individuals outside your household without authorisation.

11. Intellectual Property

All platform content, including but not limited to:

• questions,
• explanations,
• graphics,
• logos,
• software,
• analytics,
• AI-generated educational materials, and
• website design,

is owned by or licensed to AIscholar and is protected by Australian and international intellectual property laws.

You may use the content only for personal, non-commercial educational purposes.

12. AI-Generated Content

Some practice questions, explanations, analytics, and recommendations may be generated or assisted by artificial intelligence systems.

While we aim for high quality and accuracy:

• AI-generated content may occasionally contain errors or omissions;
• educational recommendations should be used as supplementary guidance; and
• parents and students should exercise independent judgment when using the materials.

13. Availability of Service

We strive to keep AIscholar available at all times, but we do not guarantee uninterrupted access.

We may:

• perform maintenance;
• update features;
• modify or discontinue parts of the service; or
• restrict access where necessary for security, operational, or legal reasons.

14. Limitation of Liability

To the maximum extent permitted by law:

• AIscholar is provided on an "as is" and "as available" basis;
• we do not guarantee specific educational outcomes, rankings, OC placement results, or Selective School admission;
• we are not liable for indirect, incidental, special, consequential, or punitive damages; and
• our total liability arising from your use of the service will not exceed the amount you paid to AIscholar in the 12 months preceding the claim.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

15. Indemnity

You agree to indemnify and hold harmless AIscholar and its operators from any claims, damages, liabilities, and expenses arising from:

• your breach of these Terms;
• misuse of the platform;
• infringement of another person's rights; or
• unlawful activities conducted through your account.

16. Privacy

Your use of AIscholar is also governed by our Privacy Policy, which forms part of these Terms.

17. Termination

You may stop using the service at any time.

We may suspend or terminate access immediately if:

• you breach these Terms;
• payment obligations are not met;
• your use creates security or legal risks; or
• we reasonably believe termination is necessary to protect the platform or other users.

Upon termination, your right to use the service ceases immediately.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising in connection with these Terms will be subject to the courts of New South Wales.

19. Changes to the Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised Last updated date.

Continued use of AIscholar after changes become effective constitutes acceptance of the revised Terms.
